The evening began with a viewing of the televised CBS newscast with Dan Rather - it would be Rather's final broadcast as anchor of the news program. In addition to the regular news, there were touching stories describing Rather's prior broadcasts and news coverage and included this statement by the retiring anchor: “Not long after I first came to the anchor chair I briefly signed off
using the word 'courage.' I want to return to it now, in a different
way, to a nation still nursing a broken heart for what happened here in
2001, and especially those who found themselves closest to the events
of Sept. 11,” he said.

A federal judge declared the reciting of the Pledge of Allegiance in public schools unconstitutional Wednesday in a case brought by the same atheist whose previous battle against the words "under God" was rejected by the U.S. Supreme Court on procedural grounds.

ruled that the pledge's reference to one nation "under God" violates school children's right to be "free from a coercive requirement to affirm God."

Karlton said he was bound by precedent of the 9th U.S. Circuit Court of Appeals, which in 2002 ruled in favor of Sacramento atheist Michael Newdow that the pledge is unconstitutional when recited in public schools.

The Supreme Court dismissed the case last year, saying Newdow lacked standing because he did not have custody of his elementary school daughter he sued on behalf of.

Newdow, an attorney and a medical doctor, filed an identical case on behalf of three unnamed parents and their children. Karlton said those families have the right to sue.

Karlton, ruling in Sacramento, said he would sign a restraining order preventing the recitation of the pledge at the Elk Grove Unified, Rio Linda and Elverta Joint Elementary school districts in Sacramento County, where the plaintiffs' children attend.

The order would not extend beyond those districts unless it is affirmed by a higher court, in which case it would apply to nine western states.

The decision sets up another showdown over the pledge in schools, at a time when the makeup of the Supreme Court is in flux.

Wednesday's ruling comes as Supreme Court nominee John Roberts faces day three of his confirmation hearings before the Senate Judiciary Committee. He would succeed the late William H. Rehnquist as chief justice.

In July, Sandra Day O'Connor announced her plans to retire when a successor is confirmed.

The Becket Fund, a religious rights group that is a party to the case, said it would immediately appeal the case to the San Francisco-based 9th U.S. Circuit Court of Appeals. If the court does not change its precedent, the group would go to the Supreme Court.

"It's a way to get this issue to the Supreme Court for a final decision to be made," said fund attorney Jared Leland.

The decisions by Karlton and the 9th Circuit conflict with an August opinion by the 4th U.S. Circuit Court of Appeals in Richmond, Va. That court upheld a Virginia law requiring public schools lead daily Pledge of Allegiance recitation, which is similar to the requirement in California.

A three-judge panel of that circuit ruled that the pledge is a patriotic exercise, not a religious affirmation similar to a prayer.

"Undoubtedly, the pledge contains a religious phrase, and it is demeaning to persons of any faith to assert that the words `under God' contain no religious significance," Judge Karen Williams wrote for the 4th Circuit. "The inclusion of those two words, however, does not alter the nature of the pledge as a patriotic activity."

Illegal immigration is a huge problem not made up by talk radio. Top state for illegal immigrants, we had the illegal immigrant from North Aftrica, Zacharias who was here. There are sleeper cells formed here in the cities and Islamo fascists as David Horowitz says. I have introduced a bill to stop ilegal immigration from other states as well as other countries, as we lead the country on the freebies given out. It will be 8 years that we will see our income tax double if we don’t get a handle on this. In 15 years if we don’t get a grip on the health & welfare spending it will dominate the entire budget much more then schools and everything else. Bush has a new plan for:

wants to let those who work here from other countries take home social security.

The US has turned a blind eye to illegal immigration and has turned a blind eye to this and is growing FASTER then China. We will be at 600 million in 20 years at this rate and thats when China started the FAMILY planning of mandatory 2 children and forced abortions/ castration etc. We are roughly the same sized minus Alaska. I’m running everywhere and I was jsut in Mississippi and they are highly concerned New Orleans will be rebuilt by illegal aliens. We have a huge problem with illegal immigration, I spoke to Washington DC, and they said go to CA and talk to them. I mentiond there isn’t ANYWHERE in the country that I go to has groups like you who are very concerned about this.

Secure the Borders Rally, Austin, Texas Oct. 1, 2005 10:30am

Secure our US Borders, Pro-America, Pro-Minuteman, Pro-Law Enforcement and Pro-Border Patrol Rally

Dear Central Texan Freepers,

As you know the Federal government is ignoring their duty in the Constitution to protect the borders of the United States. The States don't seem to do much better.

A few months ago some people organized a group of concerned citizens named the Minutemen and they conducted a Border Watch in Arizona. This shined the light upon a very serious problem of how many illegals slip across the border every night. We heard how the border citizens were able to get their 1st nights' sleep in years.

The Minutemen were also planning to have a border watch in Texas during the month of October. I planned to join them. My President has called me a "vigilante" for wanting to join the Minutemen in Texas. No, I'm just a Texas woman, & American citizen.

It is time to shine the light upon the Texas porous border. And so there is a rally planned for Saturday October 1st @ 10:30am on the south steps of the Texas Capitol in Austin, TX

The RIGHT Act would make significant strides toward implementing two of the key recommendations of the bipartisan U.S. Commission on Immigration Reform: elimination of chain migration and of the visa lottery. Its effect would be to greatly reduce current annual immigration of around 1 million to just above 300,000.

Plane Carrying Viruses Crashes in Canada

WINNIPEG, Manitoba -- A cargo plane carrying small amounts of flu
virus crashed on railway tracks near Winnipeg's city center Thursday,
killing the pilot but missing buildings and vehicles, authorities said.

The research samples of frozen influenza and herpes viruses were
destroyed in the crash and ensuing fire along with other freight,
Federal Express spokeswoman Karen Cooper said.

She said the Cessna 208 was owned by Morningstar Air Express of
Edmonton and was under contract to FedEx.

Morningstar spokesman Don Boettcher didn't immediately identify the
woman piloting the aircraft. "She'd been with us for about five years,"
he said, without providing further details.

The plane took off from the Winnipeg airport en route to Thunder Bay,
Ontario, at about 5:45 a.m. and traveled about four miles southeast
of the airport before it requested a return, Transportation Safety
Board investigator David Ross said.

"The aircraft then descended below radar coverage and contact was
lost with the aircraft," Ross said.

"It has crashed on railway tracks and does not appear to have
collided with any other objects, houses or cars," police Sgt. Shelly
Glover said.

Winnipeg police spokeswoman Carolyn Kwiatek said there was no damage
to the surrounding area from the fire. The crash did tie up traffic
on nearby streets during the morning rush, but no accidents or
injuries resulted.

In its cargo were six vials of virus samples being sent to Thunder

During the CIA's Jihad, Al-Farooq Mosque & the Alkifah Refugee Center in Brooklyn were Rahman's key bases of operation and a springboard for "the string of jihad offices that had been set up across America with the help of Saudi and American intelligence." Rahman didn't just pop up in Brooklyn by accident. Rahman received four visas from "CIA agents acting as consular officers at American embassies in Khartoum and Cairo."

Testimony barred by Pentagon

NORRISTOWN - Three men familiar with the "Able Danger" data-mining operation shut down in 2001 by the Defense Department, were warned by the Pentagon against testifying Wednesday before the Senate Judiciary Committee about the secret program.

Though Army Reserse Lt. Col. Anthony Shaffer, Navy Capt. Scott Phillpott and James D. Smith, a defense contractor, choose not to testify, Shaffer and Smith were present at the Capitol Hill hearing.

Shaffer, whose Top Secret clearance was suspended in 2004 over a disputed expense account, had his security clearance revoked Monday.

Also at Wednesday's hearing, a former Army intelligence officer, Erik Kleinsmith, told the committee that he was ordered to destroy information collected during the intelligence operation.

Congressman Curt Weldon, R-7th Dist., and other senators on the committee, chaired by Sen. Arlen Specter, R-Pa., expressed their disappointment at the Pentagon's lack of cooperation on the inquiry.

Vermont Passes Resolution To Secede From The US

The members of a peaceful freedom-fighting group want no part of neo-cons running the imperialistic U.S. government. Plan to secede from the U.S. gaining momentum in the fiercely independent Green Mountain state.
The neo-con band of criminals running Washington, trampling on civil rights at home and invading countries at will overseas, has led a large group of strong-minded Vermont freedom-fighters with no choice but to secede from the United States.
And last Friday at the state capital building in Montpelier, a historic independence convention was held, the first of its kind in the United States since May 20, 1861, when North Carolina decided to leave the Union.
A packed House Chamber in the Vermont statehouse, with more than 400 gathered, started the daylong secession convention with a speech by keynote James Howard Kunstler, author of The Long Emergency, and ended with a resolution passed to secede from the United States.
Most people think of secession as impossible if not treasonous, but the concept is deeply rooted in the Declaration of Independence, reminding us that "Whenever any form of government becomes destructive, it is the Right of the People to alter or abolish it and to institute new government."
